Mix & Move Terms & Conditions

Effective Date: September 20, 2026  ·  Last Updated: September 20, 2026

These Terms & Conditions (“Terms”) govern your access to and use of Mix & Move, a smart rotation management platform operated by Next for Success LLC (“Mix & Move,” “we,” “us,” or “our”).

By creating an account, purchasing or using a Mix & Move product or subscription, or otherwise accessing or using Mix & Move, you agree to these Terms.

If you do not agree to these Terms, do not use Mix & Move.

1. Description of the Service

Mix & Move is rotation management software designed to help event organizers create, manage, publish, and adjust participant rotations for in-person and virtual events.

Depending on the features available under an organizer’s plan, Mix & Move may allow organizers to:

Mix & Move provides rotation-management technology. It does not host, produce, supervise, manage, or operate the organizer’s underlying event.

The organizer remains responsible for the event itself, including the venue or virtual-event platform, participant management, safety, accessibility, event content, communications, and event operations.

2. Eligibility and Accounts

You must be legally able to enter into a binding agreement to create a Mix & Move organizer account or purchase a paid Mix & Move product.

You are responsible for:

You may not share account credentials in a manner intended to avoid applicable plan limits or allow unrelated organizers to use a single account as separate accounts.

3. Organizer Responsibility

Organizers are responsible for the events they create and manage using Mix & Move.

This includes responsibility for:

Mix & Move does not control the conduct of organizers, attendees, venues, virtual-event platforms, or other third parties involved in an event.

4. Plans and Usage Allowances

Mix & Move may offer free access, one-time event products, event packs, recurring subscriptions, promotional plans, or other purchasing options.

The specific price charged for a product or subscription will be the price displayed to you before purchase.

Plan features, usage allowances, and availability may change for future purchases or subscriptions. Changes will not retroactively alter event credits or subscription terms already purchased except as permitted by these Terms or as otherwise disclosed to you.

Free Trial

The Free Trial currently includes:

No credit card is required for the Free Trial unless otherwise stated before activation.

A Free Trial event is considered used when Round 1 is successfully published for the first time.

Creating, configuring, editing, duplicating, or preparing an event without publishing Round 1 does not consume the Free Trial event.

Single Event

A Single Event purchase includes:

The event credit must be used within 12 months of the purchase date unless a different expiration period is clearly stated at the time of purchase.

A Single Event credit is considered used when Round 1 is successfully published for the first time.

Creating, configuring, editing, duplicating, or preparing a draft event does not consume the event credit.

Once Round 1 has been successfully published, deleting the event does not restore the event credit.

3-Event Pack

A 3-Event Pack includes:

All unused event credits expire 12 months from the original purchase date unless a different expiration period is clearly stated at the time of purchase.

Using one event credit does not extend or restart the expiration period for the remaining credits.

An event credit is considered used when Round 1 is successfully published for the first time.

Creating, configuring, editing, duplicating, or preparing a draft event does not consume an event credit.

Once Round 1 has been successfully published, deleting the event does not restore the event credit.

Organizer Monthly

An active Organizer Monthly subscription currently includes:

An event counts toward the monthly allowance when Round 1 is successfully published for the first time.

Creating, configuring, editing, duplicating, or preparing draft events does not count toward the monthly allowance until Round 1 is successfully published.

Publishing later rounds of the same event does not consume additional event allowances.

Unused monthly event allowances do not roll over into future monthly usage periods.

Organizer Annual

An active Organizer Annual subscription currently includes:

An event counts toward the monthly allowance when Round 1 is successfully published for the first time.

Creating, configuring, editing, duplicating, or preparing draft events does not count toward the monthly allowance until Round 1 is successfully published.

Publishing later rounds of the same event does not consume additional event allowances.

Unused monthly event allowances do not roll over into future monthly usage periods.

Promotional or Launch Pricing

From time to time, Mix & Move may offer promotional, introductory, launch, grandfathered, or other special pricing for an existing plan.

Unless otherwise stated at the time of purchase, promotional pricing does not create a separate permanent plan or increase the usage allowances of the underlying plan.

If promotional renewal pricing is offered on the condition that a subscription remains continuously active, that pricing may be lost if the subscription is canceled, expires, terminates, or otherwise ceases to remain continuously active.

If the customer later subscribes again, the pricing available at that time will apply unless otherwise stated.

5. When an Event Is Considered Used

For purposes of event credits and subscription allowances, an event is considered used when Round 1 is successfully published for the first time.

The following activities do not, by themselves, cause an event to be considered used:

Once Round 1 has been successfully published, the applicable event credit or subscription allowance is considered used.

Publishing Round 2 or later rounds for that same event does not consume additional event credits or allowances.

Deleting an event after Round 1 has been successfully published does not restore the event credit or subscription allowance.

6. Multiple Products, Credits, and Subscriptions

An organizer may have more than one Mix & Move entitlement associated with an account, such as purchased event credits and an active Organizer subscription.

Unless otherwise stated:

Mix & Move may display available credits, subscription allowances, expiration dates, or similar usage information within the organizer account for convenience.

7. Purchased Credit Expiration

Purchased event credits must be used before their stated expiration date.

Creating or preparing a draft event before the expiration date does not preserve an event credit indefinitely.

To use a purchased event credit before expiration, the event must reach the applicable usage trigger—currently the successful publication of Round 1—before the credit expires.

Unused expired credits are forfeited except where otherwise required by applicable law.

8. Subscription Billing and Renewal

Recurring subscriptions automatically renew according to the billing interval and terms displayed at checkout unless canceled before the applicable renewal date.

By purchasing a recurring subscription, you authorize the applicable payment provider to charge the payment method associated with your purchase for recurring subscription fees, applicable taxes, and other authorized charges.

You are responsible for keeping your payment information current.

If a payment fails, access to paid subscription features may be restricted, suspended, or terminated.

9. Subscription Cancellation

You may cancel a recurring subscription in accordance with the cancellation method made available through Mix & Move, the applicable checkout or payment provider, or by contacting us when appropriate.

Unless otherwise stated or required by law:

If you later resubscribe, the pricing and plan terms available at that time will apply unless otherwise stated.

10. Prices and Taxes

Current prices are displayed before purchase.

Prices, promotions, discounts, and plan offerings may change for future purchases or renewal offers.

You are responsible for any taxes, duties, or similar governmental charges that apply to your purchase unless those amounts are collected and remitted by the applicable payment or checkout provider.

11. Refund Policy

Except where a refund is required by applicable law, Mix & Move purchases are non-refundable and all sales are final.

This includes:

If you believe you were charged twice, experienced a billing error, or accidentally purchased the wrong Mix & Move product, contact us at info@NextforSuccess.com as soon as possible.

We may review such requests and, where appropriate, correct confirmed billing errors or other purchase issues at our discretion.

Nothing in this Refund Policy is intended to waive any consumer right that cannot legally be waived under applicable law.

12. Attendee Information and Privacy

Organizers may enter, upload, paste, import, or otherwise provide attendee information to Mix & Move.

The organizer represents that they have the right or appropriate authority to provide and use that information for the event.

Organizers are responsible for providing any notices and obtaining any permissions or consents required for their collection and use of attendee information.

Mix & Move may process attendee information to provide the service, including generating rotations, displaying assignments, preserving completed-round participation history, and providing event results.

Our collection and use of personal information is further described in the Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference.

13. Event Information and Attendee Access

Mix & Move may allow attendees to access event information through a browser-based attendee page, link, or QR code.

Depending on the event configuration, attendees may be able to see information such as:

Organizers are responsible for determining how attendee links and QR codes are distributed and for managing access to their event.

14. Rotation Plans and Event Outcomes

Mix & Move uses software logic to generate and manage event rotations based on the information and settings available to the system.

Because real events may involve changing attendance, uneven participant counts, fixed hosts, limited tables or rooms, late arrivals, early departures, organizer adjustments, and other constraints, Mix & Move does not guarantee:

Mix & Move is designed to help organizers manage rotations and improve connection variety, but the organizer remains responsible for reviewing and operating the event.

15. Completed Rounds and Future Adjustments

Mix & Move may allow organizers to update attendance or other event information after an event has begun.

When supported by the service, future rounds may be recalculated or adjusted based on updated event information while completed rounds and recorded connection history remain intact.

Organizers are responsible for reviewing updated rotations before publishing them.

We do not guarantee that every adjustment will produce a particular pairing, table balance, or event outcome.

16. Fixed Participants

Mix & Move may allow organizers to designate certain participants—such as table captains, hosts, facilitators, mentors, interviewers, or experts—to remain assigned to a particular table, room, station, or other location while other attendees rotate.

The organizer is responsible for selecting and configuring fixed participants appropriately for the event.

Fixed-participant requirements may affect the number, variety, or distribution of attendee connections that can be generated.

17. Acceptable Use

You agree not to use Mix & Move to:

Organizers may use Mix & Move in connection with their own paid events, client events, professional services, consulting, event-management services, or other commercial activities, subject to the usage limits of their applicable plan.

These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use Mix & Move in accordance with your applicable plan and these Terms.

Except as expressly permitted, you may not copy, reproduce, distribute, modify, create derivative works from, sell, license, or exploit Mix & Move or its proprietary materials without written permission.

19. Organizer Content

You retain any ownership rights you may have in content and information you provide to Mix & Move.

You grant Mix & Move and Next for Success LLC a limited right to host, process, reproduce, display, and otherwise use that content as reasonably necessary to provide, maintain, secure, and improve the service.

You represent that you have the rights and permissions necessary to provide such content and permit its use for these purposes.

20. Third-Party Services

Mix & Move may rely on, integrate with, or link to third-party products and services, including hosting providers, database providers, payment processors, email providers, analytics services, and virtual-event platforms.

Your use of third-party services may be governed by separate terms and privacy policies.

Mix & Move is not responsible for the availability, security, performance, content, policies, or actions of independent third-party services.

21. Service Availability

We work to keep Mix & Move available and functioning, but we do not guarantee uninterrupted, error-free, or continuously available service.

The service may occasionally be unavailable because of maintenance, updates, technical problems, internet or infrastructure failures, third-party service interruptions, security issues, or circumstances beyond our reasonable control.

Organizers are responsible for maintaining reasonable backup plans for event operations.

22. Changes to the Service

We may modify, improve, add, remove, or discontinue features of Mix & Move from time to time.

We may also change future plan offerings, allowances, or pricing.

Where changes materially affect an active paid subscription, we will provide notice when required by applicable law or when otherwise appropriate.

23. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIX & MOVE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DISCLAIM WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT MIX & MOVE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR EVERY EVENT OR USE CASE.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above limitations may not apply to you.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXT FOR SUCCESS LLC, MIX & MOVE, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF MIX & MOVE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO MIX & MOVE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO MIX & MOVE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

If applicable law does not allow a limitation described above, the limitation will apply only to the maximum extent permitted by law.

25. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Next for Success LLC, Mix & Move, and their owners, officers, employees, contractors, and affiliates from claims, liabilities, damages, losses, and reasonable costs or expenses arising out of or related to:

This section does not require indemnification to the extent prohibited by applicable law.

26. Suspension and Termination

We may suspend or terminate access to Mix & Move if we reasonably believe that:

Where reasonable under the circumstances, we may provide notice and an opportunity to correct a violation before termination.

Termination or suspension does not automatically create a right to a refund.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to Mix & Move, our business practices, legal requirements, or service offerings.

When we update these Terms, we will revise the Last Updated date at the top of the page.

If a change materially affects active users or subscribers, we may provide additional notice when appropriate or required by law.

Continued use of Mix & Move after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

28. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any rights or procedures that cannot legally be waived, disputes arising out of or relating to these Terms or Mix & Move will be brought in the appropriate state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.

Nothing in this section limits any rights you may have under mandatory consumer-protection laws that apply to you.

29. General Terms

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or similar business transaction.

These Terms, together with the Privacy Policy and any additional terms presented to you in connection with a specific product, subscription, or promotion, constitute the agreement between you and Next for Success LLC regarding your use of Mix & Move.
